A recent federal court ruling on January 9, 2025, vacated the 2024 Title IX Regulations nationwide. The U.S. Department of Education’s Office for Civil Rights (OCR) has confirmed that schools must revert to the 2020 Title IX Regulations, as outlined in their Title IX and Sex Discrimination Overview.

What This Means for Schools:

  • California schools are required to align their procedures with the 2020 Title IX regulations and California's Sex Equity in Education Act, which include protections against sex-based discrimination.
  • School policies based on the 2024 Title IX regulations should no longer be used. Schools should ensure compliance with the 2020 Title IX framework.

Next Steps for Schools:

  • Schools should transition back to 2020 Title IX compliant policies and procedures.
  • Schools should continue to review and utilize resources from the OCR and PRISM’s School Administrator’s Guide to Preventing Sexual Abuse & Misconduct, which includes a dedicated section on addressing Title IX.
  • Monitor updates from the U.S. Department of Education and the California Department of Education regarding potential future changes.

PRISM Risk Control will continue to monitor these developments and share any additional updates as they are released, ensuring schools remain informed and supported in fostering safe, equitable environments for students and staff. For any additional information, please contact Scarlett Sadler.
