Overview
Many managers and supervisors are writing performance evaluations without an appreciation of the legal pitfalls inherent in this process. Your public agency uses templates and forms for identifying performance objectives and writing clear, relevant and effective evaluations. Naturally, the focus should be on the substantive aspects of the employee’s performance during the relevant review period.
Finally, evaluators, and the HR and risk management professionals who support and guide them, should not overlook the critical risks for lawsuits or grievances when written comments stray into areas where the employee enjoys legal rights and policy protections. There are key subjects that must be addressed properly, or not at all.
