Update on Wage and Hour Issues for Public Entity Employers

Overview

While this webcast is open to all EIA members, some of the Eyres Law Group Services are only available to members of the PWC and/or GLl programs.

Overview

Lawsuits seeking back wages and penalties under the Fair Labor Standards Act (FLSA) are at an all time high, following seven years of increases. The Department of Labor’s Wage and Hour Division has increased its enforcement budget and proposed sweeping changes that will surely heighten compliance concerns.

We have also seen an uptick in requests for assistance on the CSAC EIA hotline with wage policies and compliance requirements. This webinar will provide both an update on litigation trends, areas of exposure and new regulations on the horizon that will impact every public agency’s policies.

Topics Include

  • Recent trends in litigation and regulation against employers under the FLSA, with emphasis on public sector workplaces
  • Distinguishing between exempt and non exempt employees, and proper methods of classifying individuals who meet the threshold requirements of the “management” exemption
  • How the new proposed DOL overtime regulations on the “salary basis test” will result in many more employees being classified as “exempt” based on the “salary basis test.”
  • How to survive a DOL audit of your payroll classifications
  • Misclassification lawsuits involving contractors, freelancers, and temps: who is actually an employee and why DOL’s enforcement budget has mushroomed.
  • How to prevent “unintended overtime” exposure when non exempt employees respond to calls or email, or perform other tasks on their Smartphones
  • Everything you ever wanted to know about travel policies for non exempt employees: travel time, out of town versus local travel, differences between compensable time and travel expense reimbursements, guidelines and requirements for paying non exempt staff for out of town travel, and more.
  • When attending lectures, meetings and training programs is compensable time
  • Meal periods and rest periods – differences between FLSA and California requirements
  • Components of the Equal Pay Act under FLSA
  • Lactation accommodations for breastfeeding employees under the FLSA, enacted as part of the Affordable Care Act
  • How to assure compliance with the FLSA and understand where an applicable MOU may provide broader protections
  • Understanding differences between the basic legal requirements, more generous MOU requirements, governing policies and “informal” practices
  • How to sidestep successful claims that your agency’s unwritten “practices” have actually become a policy that you must follow or formally change on a prospective basis
  • DOL fact sheets for specific positions in the public sector
  • When public agencies must comply with California Industrial Welfare Commission Wage Orders
  • High profile lawsuits for retaliation by public employees who claimed retaliation for filing a complaint or participating in a legal proceeding under the FLSA
  • Future trends: hot issues on the horizon for regulation and wage and hour litigation
