Employment practices liability is still a growing area of concern for public and private employers alike. There are dozens of EPL landmines that employers must recognize and then implement proactive risk prevention strategies.

- Cyber liabilities: information security is a hot button issue. More records are managed with digital systems and networks remain vulnerable to unauthorized access. In addition to risks of inadvertent or deliberate disclosures, there are a host of liability concerns about the impact of electronic records management, internal and external access and the impact of BYOD and social media in government workplaces.
- Work Environments: Hostile environment harassment, abusive conduct and bullying charges simply won’t go away. In fact, we expect to see more claims of general bullying, as public sector employees increasingly complain about climates of fear and intimidation. Election years are always ripe for “hot button” divisive issues that breed claims of racial, religious and national origin harassment (HR professionals remember the jump in conflicts and claims when Proposition 187 was a hot button issue in California). We also expect to another spike in retaliation and whistleblower claims, as well as more gender identity and expression issues in both public schools and the workplace.
- Expanded Privacy Rights: The focus of this section will be on why “privacy” will be front and center in both employment and education law. We will tie this together with all five of the top legal landmines, as “privacy” for employees, students and other stakeholders is a common legal and policy thread that permeates all other workplace compliance issues.
- Return to Work/Stay at Work: This section will focus on the specific issues that are before state and federal agencies and courts that will further expand reasonable accommodations both in employment and public accommodations.
- Technical Compliance issues: 2015 was a “banner year” for developments in both electronic discovery (civil litigation) and California Public Records Act requirements. We will highlight the recent decisions and those we expect from the California Supreme Court in the first quarter of 2016.
