Mandated Reporting for Healthcare Providers in California: Who, What, When, How, Why and HIPAA

Overview

This class will review the basics of mandated reporting for healthcare providers in California.  We will discuss the categories of individuals who, because of their employment, must report 

  1. child abuse and neglect and the immunities they enjoy
  2. elder/dependent adult abuse and neglect
  3. gunshot wounds and other suspicious injuries suspected to have been caused by assaultive or abusive conduct
  4. in behavioral health, the so-called Tarasoff "duty to warn."

We will look at "who" is a mandated reporter, "what" must be reported, and when it must be reported.  We will talk about how to make a report and how to document in the patient record that a report has been made, and why reports are sometimes needed even in the case of past harm.  We will also review what HIPAA and other state and federal laws say about confidentiality, and how exceptions to privacy rules permit us to perform our mandated duties.
