How to Discipline Employees with Current or Recent Industrial Injury Claims without Drawing a LC 132a or Retaliation Lawsuit

Overview

While this webcast is open to all EIA members, some of the Eyres Law Group Services are only available to members of the PWC and/or GL1 programs.

Overview

Many employers are fearful about taking disciplinary action against a worker who has a current or recent claim for an industrial injury. While retaliation claims are easily asserted and often challenging to defend, departments can't be held hostage by the law, so afraid of drawing a lawsuit that they don't take prompt disciplinary action when it is deserved. This breeds frustration for management and potential claims of unjust favoritism by peers.

This webinar is for HR and risk professionals, as well as front-line leaders. Patricia Eyres from the Eyres Law Group, will provide up to date case law and strategies for assuring that your disciplinary procedures will pass muster, both in a due process context and in a subsequent legal action. We will provide practical examples, sample notices of intent, reprimands and other disciplinary documentation.
