SB 487 Subrogation Shake-Up: Navigating Your New Recovery Rights
Overview
Effective January 1, 2026, SB 487 reduces an employer’s right of recovery in subrogation cases involving city and county peace officers and firefighters to one-third of a recovery from a third-party if certain criteria are met. Further, it eliminates the right to credit for a third party recovery received by the injured worker. We will discuss how you can identify which cases this applies to and discuss how to protect yourself versus when to cut your losses.
