Election Workers: How does your entity address this classification of temporary volunteer workers? |

With the upcoming elections, it’s important to understand your entity’s determination on how to address any injuries or liability arising during the course of an Election Worker’s assignment. This may include training for the Supervisors or Team Leads at each polling location as to what forms to provide, if applicable, and to avoid misinformation being provided.
Has your entity determined how you wish to cover Election Workers should an injury and/or liability arise during the course of their assignment? Because Election Workers are unique, short-term, project specific (election period) and individuals hired to work various components of an election may or may not be considered an Employee for the purposes of workers’ compensation coverage. Election Workers may not fit into a one-size fits all given their various types of classifications, including but not limited to, volunteer with no pay, volunteer with stipend pay, extra-help with hourly pay, etc.
What are your options? One option is to adopt a Resolution indicating the governing body’s intention of whether to consider Election Workers as employees and provide workers’ compensation coverage. You may already have this in place and no further action may be warranted. Another option may be to specifically state they are not considered employees and not covered under workers’ compensation. In the latter option, the remedy for an injury occurring during their assignment could be subject to civil remedies.
We recommend deciding in advance by working with your entity’s Counsel so that the proper resolutions are either in place or an affirmative decision has been made to not cover volunteers meaning they would go through the tort claim process. For any questions, please reach out to Jen Hamelin. |
