Governor Brown Signs Assembly Bill 1749 into Law
Assembly Bill 1749 was introduced as a result of the brave and good-Samaritan acts displayed by so many peace officers and citizens during the tragic Route 91 Harvest Festival shooting that occurred in Las Vegas in October 2017. The bill intended to clarify workers’ compensation laws for out-of-state injuries for peace officers.
The initial version of the bill provided a mandatory provision that all out-of-state injuries are compensable. Through amendments, the final version allows each public agency to determine the policy of awarding workers’ compensation benefits for off-duty peace officers when outside of the State of California.
The amendments also provide limits to the liability for the public agency when a third party is allegedly harmed by the off-duty peace officer while traveling out of state, and exercising their peace officer powers per the Penal Code. Additionally, it provides clarity on the purpose of this bill, clarifying that this is not a misuse of public or taxpayer funds.
While the amendments lessened the liability associated with the bill, it’s important to review existing policy to either ensure it will not expose your entity or to expanded coverage and strengthen it if it does.

Reminder to Property Program Members: Grant Program Deadline is October 15th
The deadline for applications is Monday, October 15th – there is still time to make a request. Please provide documentation about the cost (invoice/proposal) and how you are addressing a Property Program exposure - there is no formal application. Requests must be submitted to Sarah Bruno in the EIA’s Risk Control Department. The Property Committee will consider requests at their next meeting, which is anticipated to be held before the end of the year.
If your entity is part of the Property Program, take advantage of a great financial resource: Property Program Matching Grants. This program includes up to $25k per member, per year on a matching basis. The funds may be used for risk control programs designed to reduce exposures associated with the Property Program. One great way to use these matching funds is for protecting vacant buildings. Other ways to use the funds are hazard inspections, other risk identification evaluations on specific locations, or implementation of security measures such as alarm systems or guard services.
